Terms of Service

1. Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Users under 16 in the European Economic Area or United Kingdom must have verifiable parental or guardian consent.

2. Accounts

3. Subscriptions and Billing

We offer a paid subscription with a 30-day free trial, billed monthly through our payment provider. By starting a trial or paid subscription, you authorize recurring charges until you cancel. You may cancel at any time; access continues until the end of the current billing period. Refunds are governed by our payment provider's policies and applicable law. Fees may change with reasonable advance notice; existing subscribers keep the prior rate through the current billing cycle.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful, harmful, fraudulent, or infringing purpose;
• Harass, threaten, or impersonate another person, including in comments or community features;
• Upload or transmit malware, or attempt to disrupt or gain unauthorized access to our systems;
• Scrape, copy, or redistribute our content in bulk without permission;
• Use automated tools to access the Services in a way that exceeds reasonable personal use;
• Circumvent paywalls, access controls, or any technical protection measures.

5. User-Generated Content

Where we offer comments, submissions, polls, or other interactive features, you retain ownership of content you submit but grant us a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute it in connection with the Services. You represent that you have the rights to your content and that it does not violate law or third-party rights. We may moderate, edit, or remove content at our discretion.

6. Journalist and Contributor Submissions

If you submit an article, editorial, or other work for publication, you grant PENN a non-exclusive license to edit, publish, and distribute your submission across our platforms. We review submissions before publication and may accept, reject, or request revisions. We are not obligated to publish any submission and do not guarantee a response.

7. Editorial Standards

PENN is committed to non-partisan, neutral coverage. Our content reflects our editorial judgment at the time of publication and may be updated as facts develop. Opinions expressed in editorials or commentary are those of the author and not necessarily of PENN. Nothing in the Services constitutes legal, financial, medical, or professional advice.

8. Third-Party Content and Links

The Services may contain links to third-party websites, advertisements, and affiliate offers. We do not control and are not responsible for third-party content, products, or services. Your interactions with third parties are solely between you and them. Affiliate and advertising relationships do not influence our editorial coverage.

9. Intellectual Property

All content on the Services — including articles, editorials, podcasts, puzzle games, graphics, logos, and software — is owned by or licensed to PENN and protected by intellectual property laws. You may not copy, reproduce, or redistribute our content beyond personal, non-commercial use without written permission. Our puzzle games (SLANT, FUSE, SEAM, and LINK) are original works created by Franklin A. Malpass for PENN.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any information is accurate, complete, or reliable. To the fullest extent permitted by law, we disclaim all warranties.

11. Limitation of Liability

To the fullest extent permitted by applicable law, PENN and its affiliates, officers, employees, and contributors shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars if you have not paid us.

12. Indemnification

You agree to indemnify and hold harmless PENN and its affiliates from any claims, damages, or expenses arising out of your content, your violation of these Terms, or your misuse of the Services.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access for any reason, including a violation of these Terms, without notice. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will remain in effect.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Material changes will be communicated through the Services or by email. Your continued use after changes take effect constitutes acceptance of the revised Terms.
